1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of homesolutionsdiy.com (the "Website"), operated by Digital Wave Media DBA Homesolutions DIY ("we", "us", "our"). By accessing the Website or submitting information through it, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website.

These Terms contain an arbitration agreement and class-action waiver (Section 11) that affect your legal rights.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Website. By submitting a request, you confirm that the information you provide is accurate and that you are the owner or authorized user of the phone number and email address you provide.

3. Nature of Our Service

We are a free marketing lead generator and referral service. We do not perform home improvement work, sell products, issue quotes, or act as a contractor, lender, broker or insurer. We share the information you submit with third-party providers, marketers and lead aggregators (our "Marketing Partners", listed here), who may contact you. We are compensated by those Marketing Partners.

We do not endorse, recommend or guarantee any Marketing Partner, and we are not party to any agreement between you and a provider. You are responsible for verifying a provider's licensing, insurance, qualifications and references.

4. Consent to Be Contacted (TCPA)

By checking the consent box and submitting a form, you provide your express written consent, under the Telephone Consumer Protection Act (TCPA) and similar state laws, for Digital Wave Media DBA Homesolutions DIY and its Marketing Partners to contact you at the phone number and email address you provided about home improvement products and services. Contact may include calls and text messages (SMS/MMS) placed using automated technology, an automatic telephone dialing system, and artificial or prerecorded voice messages, even if your number is listed on any federal, state or company Do Not Call registry.

Your consent is not a condition of purchasing any goods or services. You may revoke consent at any time by any reasonable means, including replying STOP to a text message, telling a caller you no longer wish to be contacted, or emailing contact@homesolutionsdiy.com. Revoking consent with us does not automatically revoke consent you gave directly to a Marketing Partner; you may need to contact them separately.

5. Text Message Terms

Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages. You agree to notify us if you change or deactivate the phone number you provided.

6. Electronic Signature and Records

You agree that checking the consent box and clicking the submit button constitutes your electronic signature under the federal E-SIGN Act and applicable state laws, and that we may record and retain records of your consent, including through third-party verification services such as TrustedForm, which capture a record of your visit and form interaction.

7. Acceptable Use

You agree not to submit false information or information about another person without authorization; use the Website for any unlawful purpose; interfere with the Website's operation or security; use bots or scrapers to access the Website; or copy or redistribute Website content without permission.

8. Intellectual Property

All Website content, including text, graphics, logos and design, is owned by or licensed to us and protected by intellectual property laws. You may view the Website for personal, non-commercial use only.

9. Third-Party Sites and Services

The Website may link to or redirect you to third-party websites. We are not responsible for their content, terms or privacy practices, and your use of them is at your own risk.

10. Disclaimers and Limitation of Liability

THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT YOU WILL BE MATCHED WITH ANY PROVIDER OR RECEIVE ANY QUOTE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY ACT OR OMISSION OF ANY MARKETING PARTNER OR PROVIDER. OUR TOTAL LIABILITY SHALL NOT EXCEED $100.

11. Dispute Resolution; Arbitration; Class Waiver

Any dispute arising out of these Terms or your use of the Website will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from your violation of these Terms or your submission of inaccurate information or information belonging to another person.

13. Governing Law

These Terms are governed by the Federal Arbitration Act and, to the extent not preempted, the laws of the State of Wyoming, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms from time to time. The "effective" date above shows the latest revision. Continued use of the Website means you accept the updated Terms.
